The man accused of assaulting Rudy Giuliani at ShopRite in Staten Island will have his charges dropped within six months if he doesn’t break the law within that time limit.

CBS The Richmond County District Attorney’s Office case was adjourned over consideration of dismissal, it was reported Wednesday. According to CBS, that means Daniel Gill — a ShopRite worker who was suspended following his June encounter with Giuliani — will be suspended if he doesn’t break the law within six months. will not be penalized.

According to CBS, Assistant Richmond County Attorney Darren Albanese said in court Wednesday that Jill “violated a basic social contract that we were taught when we were young. Lesson – mind your own business.” However, he added, it would be “extremely difficult” to prove that Giuliani was physically harmed by Gil’s slapping of Giuliani’s back.

“As we have maintained since earlier this year, Daniel Gill, who had no previous contact with the criminal legal system, did not commit any criminal act, and this outcome, which will ultimately dismiss the case entirely, reflects that reality,” Say Legal Aid Society on Twitter Wednesday. The group is currently representing Gill in the case.

The incident involved Jill slapping Giuliani on the back as he walked past him in the store.The former New York mayor was later invited to participate in the Curtis Sliva, former New York mayoral candidateclaiming that Jill’s slap on the back felt like “a shot.”

“I mean, let’s say I’m a weak 78-year-old, and I fall to the ground, break my skull, and die,” Giuliani told Sliwa.

However, Video of the incident released by the New York Post Giuliani did not appear to be shown leaning forward or losing his balance after being hit. The video also appears to show Giuliani standing upright and pointing at the man.

ShopRite’s parent company said Gill had been “suspended pending termination” over the incident. While Gill was initially arrested on a felony second-degree assault, he was later released without bail on a misdemeanor charge. The Legal Aid Society said Giuliani had exaggerated the incident.

Giuliani did not immediately respond to Insider’s request for comment.
